Website and Email Privacy Policy

This Privacy Policy governs the manner in which The Clearing collects, uses, maintains and discloses information collected from users (each, a “User”) of the www.theclearingnw.com or the www.theclearingnw.org website (“Site”). This privacy policy applies to the Site and all services offered by The Clearing, SPC.

Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Non-Personal Identification Information

We may collect non-personal identification information about Users whenever they interact with our Site. The Clearing SPC has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our Site. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your Acceptance of These Terms

By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.

Protected Healthcare Information and Medical Records

Information regarding your health care, including payment for health care, is protected by two federal laws: the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), 42 U.S.C. § 1320d et seq., 45 C.F.R. Parts 160 & 164, and the Confidentiality Law, 42 U.S.C. § 290dd-2, 42 C.F.R. Part 2. Under these laws, The Clearing, SPC may not say to a person outside The Clearing that you attend the program, or disclose any other protected information except as permitted by federal law.

The Clearing, SPC must obtain your written consent before it can disclose information about you for payment purposes. Generally, you must also sign a written consent before The Clearing, SPC can share information for treatment purposes or for health care operations. However, federal law permits The Clearing, SPC to disclose information without your written permission:

  1. Pursuant to an agreement with a qualified service organization/ business associate;
  2. For research, audit or evaluations;
  3. To report a crime committed on The Clearing, SPC’s premises or against The Clearing, SPC personnel;
  4. To medical personnel in a medical emergency;
  5. To appropriate authorities to report suspected child abuse or neglect;
  6. As allowed by a court order.

Before The Clearing, SPC can use or disclose any information about your health in a manner which is not described above, it must first obtain your specific written consent allowing it to make the disclosure. Any such written consent may be revoked by you in writing.

Your Rights

Under HIPAA you have the right to request restrictions on certain uses and disclosures of your health information. The Clearing, SPC is not required to agree to any restrictions you request, but if it does agree then it is bound by that agreement and may not use or disclose any information which you have restricted except as necessary in a medical emergency.

You have the right to request that we communicate with you by alternative means or at an alternative location. The Clearing, SPC will accommodate such requests that are reasonable and will not request an explanation from you. Under HIPAA you also have the right to inspect and copy your own health information maintained by The Clearing, SPC, except to the extent that the information contains psychotherapy notes or information compiled for use in a civil, criminal or administrative proceeding or in other limited circumstances.

Under HIPAA you also have the right, with some exceptions, to amend health care information maintained in The Clearing, SPC’s records, and to request and receive an accounting of disclosures of your health related information made by The Clearing, SPC during the six years prior to your request. You also have the right to receive a paper copy of this notice.

The Clearing, SPC’s Duties

The Clearing, SPC is required by law to maintain the privacy of your health information and to provide you with notice of its legal duties and privacy practices with respect to your health information. The Clearing, SPC is required by law to abide by the terms of this notice. The Clearing, SPC reserves the right to change the terms of this notice and to make new notice provisions effective for all protected health information it maintains.
